These Terms & Conditions apply to all distance-selling purchases made from Headstock Music through our website or by telephone.

2. Definitions

  • “Consumer” means an individual acting wholly or mainly outside their trade, business, craft or profession.
  • “Goods” means the products sold by us.
  • “Contract” means the legally binding agreement between you and us for the sale of Goods.

Nothing in these Terms affects your statutory rights under UK consumer law.

3. Scope of these terms

These Terms apply to:

  • Orders placed through our website
  • Orders placed by telephone with our sales team
  • All related communications and transactions concerning your order

If you do not agree to these Terms, please do not place an order.

4. Pre-contract information (Distance selling)

Before you place an order (online or by telephone), we provide clear information including:

  • our identity and contact details
  • a description of the Goods
  • the total price, including taxes and delivery charges
  • delivery arrangements
  • your cancellation rights and any applicable return costs

After placing an order, we provide confirmation of the Contract and the required information in a durable medium (such as email) no later than delivery. For telephone orders, we will email you an order confirmation and a copy or link to these Terms.

5. Forming the contract

5.1 Website orders

When you place an order online, you will receive an automated order acknowledgement email. This does not constitute acceptance of your order.
A Contract is formed only when we dispatch the Goods and send you a dispatch confirmation email.

5.2 Telephone orders

When you place an order by telephone, we will confirm the order details during the call and then send written confirmation by email.
A Contract is formed only when payment is authorised or taken and the Goods are dispatched.

5.3 Refusal or cancellation before dispatch

We may refuse or cancel any order before dispatch and issue a full refund where, for example:

  • payment authorisation fails
  • there is an error in pricing or product description
  • the Goods are unavailable
  • we reasonably suspect fraud or misuse of our systems

6. Prices & Payment

6.1 Pricing

All prices are shown in GBP (£) and include VAT where applicable. Any delivery charges will be shown separately before checkout or confirmed during a telephone order.

6.2 Payment methods

We accept payment using the methods made available at checkout or confirmed at the time of order. These may include debit or credit card, PayPal, and other payment methods offered from time to time.
For telephone orders, payment will be taken securely during the call or via a secure payment link.

6.3 Deferred payment and instalment options

From time to time, we may offer deferred payment or instalment options, such as “Pay in 3”, provided by PayPal or other third-party payment providers (“Deferred Payment Providers”).
Deferred payment options allow you to split the cost of your purchase into instalments, subject to eligibility checks and approval by the relevant Deferred Payment Provider.

Headstock Music does not provide credit and is not a lender or credit broker. Any deferred payment or credit agreement is entered into directly between you and the relevant provider and is governed by their separate terms and conditions.

6.4 How deferred payment works

If you choose to pay using a deferred payment option:

  • you enter into a direct agreement with the Deferred Payment Provider;
  • approval decisions are made solely by that provider;
  • we receive full payment for the Goods from the provider at the time of purchase; and
  • you make repayments directly to the provider, not to us.

6.5 Important information

Borrowing more than you can afford or missing payments may negatively impact your financial position or ability to obtain credit. You should ensure that you can afford repayments before selecting a deferred payment option.

Your statutory consumer rights in relation to the Goods remain unchanged, including your rights to cancel or return items in accordance with these Terms.

7. Delivery

  • We deliver to UK addresses only, unless otherwise stated.
  • Estimated delivery times are provided as guidance and are not guaranteed.
  • Risk in the Goods passes to you when they are delivered to the address you provided.
  • Ownership of the Goods passes to you once we have received full payment.

8. Your right to cancel (change your mind)

8.1 Cancellation period

For most Goods purchased online or by telephone, you have a legal right to cancel your order within 14 days of receiving the Goods, without giving a reason.

8.2 How to cancel

To cancel, please contact us using the details in section 1 within the 14-day period. Any clear statement is sufficient (email is fine).

8.3 Returning Goods

If you cancel, you must return the Goods within 14 days of telling us you wish to cancel.
Unless the Goods are faulty or incorrect, you are responsible for the direct cost of returning them.

If you request that we arrange collection for a change-of-mind return, we will charge a collection cost, which will be confirmed to you in advance.

We advise that you unwrap products with reasonable care, retain all original packaging, and inspect the goods. If you choose to return the goods, they should be returned in their original condition, with all original packaging included where reasonably possible

8.4 Handling and deductions

You may handle the Goods to establish their nature, characteristics and functioning in the way you would in a shop.
If you handle the Goods beyond this, we may reduce your refund to reflect any reduction in value.

8.5 Refunds

If you cancel, we will refund:

  • the price you paid for the Goods; and
  • the cost of standard delivery (if paid)

We will not refund any additional charge for express or upgraded delivery.
Refunds will be made within 14 days of receiving the returned Goods or evidence that they have been returned, whichever is earlier, using the original payment method.

9. Faulty or incorrect good

Your rights under the Consumer Rights Act 2015 apply.

If Goods are faulty, not as described, or not fit for purpose:

  • you may be entitled to reject them within 30 days for a full refund; and/or
  • you may be entitled to a repair or replacement, and in some cases a price reduction or final refund.

If you receive incorrect Goods or Goods damaged in transit, please notify us as soon as reasonably possible so we can resolve the issue promptly. This does not affect your statutory rights.

10. Items that cannot be returned (except if faulty)

The following items cannot be returned for change-of-mind cancellation where the law provides an exception:

  • digital content or downloads once access has begun after you have agreed to lose the right to cancel
  • sealed hygiene items once unsealed (e.g. Headphones)
  • personalised or custom-made or special-order items made to your specifications
  • gift cards or vouchers

11. Defective Goods & Warranties

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015. Any warranty provided is in addition to, and does not replace, those rights.

New Products – Warranty

    1. All new products are supplied with a minimum warranty period of three (3) years, unless otherwise stated.
    2. If a product develops a manufacturing fault within six (6) months of delivery, it is presumed to have been faulty at the time of delivery unless we can demonstrate otherwise. In such cases, we will arrange collection and repair of the product at no cost to you.
    3. If the product cannot be repaired within a reasonable time, we will offer a replacement or refund in accordance with your statutory rights.
    4. If a product develops a manufacturing fault after six (6) months from the date of delivery but within the warranty period, we may ask for reasonable evidence that the fault is due to a manufacturing defect. Where appropriate, you may be responsible for the reasonable cost of returning the product to us for assessment.

Ex-demo or B-stock products – Warranty

  1. Ex-demo or B-stock products are supplied with a minimum warranty period of one (1) year, unless otherwise stated.
  2. If an ex-demo or B-stock product develops a manufacturing fault within six (6) months of delivery, it is presumed to have been faulty at the time of delivery unless we can demonstrate otherwise. In such cases, we will arrange collection and repair of the product at no cost to you.
  3. If the product cannot be repaired within a reasonable time, we will offer a replacement or refund in accordance with your statutory rights.
  4. If a manufacturing fault arises after six (6) months from delivery but within the warranty period, we may ask for reasonable evidence that the fault is due to a manufacturing defect, and you may be responsible for reasonable return costs.

All Products – Warranty Exclusions

  1. Warranties do not cover faults caused by misuse, accidental damage, neglect, unauthorised repairs or modifications, normal wear and tear, or any cause other than a manufacturing defect.
  2. If a returned product is inspected and found not to be faulty, we may return the product to you and charge a reasonable fee to cover inspection and return delivery costs. Any such charge will be communicated to you in advance where possible.

Repairs and Replacements

  1. Where repair is the appropriate remedy, we will complete repairs within a reasonable timeframe.
  2. Where a replacement is provided, it will be of equivalent type and functionality. Replacement items may be new or refurbished but will be fully functional and not of lesser condition than the original product supplied.
  3. Any repair or replacement does not extend or restart the original warranty period.

Proof of purchase

Reasonable evidence of purchase may be required to process warranty or service requests. This may include a receipt, order confirmation email, or other reasonable proof of purchase. Failure to provide a physical receipt alone will not invalidate your statutory rights.

12. Telephone call recording

We may record telephone calls for training, quality assurance, and order accuracy. Where calls are recorded, recordings are handled in accordance with UK data protection law and our Privacy Policy.

13. Website use, availability & automared access

13.1 Availability

We aim to keep our website available, but we do not guarantee uninterrupted access and may suspend or restrict availability for maintenance, updates, or events beyond our reasonable control.

13.2 Third-party content

Our website may include third-party content or links (including embedded videos). Such content remains the responsibility of the relevant third party. We do not control or endorse third-party content.

13.3 Prohibited use and automated access

You must not misuse our website. Without our prior written consent, you must not use automated systems (bots, scrapers, scripts, crawlers or similar tools) to extract data, monitor prices, or analyse content.
Where unauthorised automated activity or misuse is detected, we may take reasonable technical and legal steps, including blocking access or pursuing legal remedies where appropriate.

14. Intellectual Property

All intellectual property rights in content created by us on this website (including text, branding, design elements, and original product descriptions and images) are owned by or licensed to us.
Third-party content (including embedded videos and third-party trademarks) remains the property of the respective rights holders.

15. Liability

Nothing in these Terms limits or excludes our liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or fraud.
Subject to the above, we are not liable for losses that are not reasonably foreseeable. We are not liable for business losses (such as loss of profits, revenue, contracts, or goodwill) where you are purchasing as a Consumer.

If you have a complaint, please contact us using the details in section 1 and include your order number where possible.
We aim to acknowledge complaints within 5 working days and resolve them as quickly as reasonably possible.

18. Events beyond our control

We are not responsible for delay or failure to perform our obligations were caused by events beyond our reasonable control. We will perform our obligations as soon as reasonably practicable once the event has ended.

19. Changes to these terms

We may update these Terms from time to time. The version in force at the time you place your order will apply.

20. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
